Outraged from Its Land Being Seized, Local Family Takes Tredyffrin-Easttown School District to Court

Outraged that its land is being seized by eminent domain, the McDonnell family is taking the Tredyffrin-Easttown School District to court, writes Caroline O’Halloran for SAVVY Main Line.

The district has offered the landowners and proprietors of the Doyle & McDonnell Nursery $2.7 million for a 13-acre parcel next to Conestoga High School.

However, the family claims the district is operating in bad faith because its offer does not even come close to the $4.5 million deal they already signed with Horsham-based Toll Brothers.

The district had previously extended two offers to the family: $2.9 million and $3.1 million. Then, last week, the family was notified that if they do not accept the latest offer of $2.7 million, the district will pursue all “means available to it under eminent domain code to secure physical possession.”

Meanwhile, the school district claims that $2.7 million is the current valuation of the land set by its appraiser, Coyle Lynch.

“We have an obligation to pay fair market value for the property,” said district solicitor Ken Roos. “The school district can’t expect its taxpayers to overpay for a property.”
