Malvern’s Endo Settles Two Cases Before Trial; 2,000 Lawsuits Filed by Local Governments Remain Intact

Endo International, the Dublin-based pharmaceutical company with a U.S. headquarters in Malvern, has paid $11 million to avoid going to trial.

This was to settle in the first federal court cases brought against opioid makers and distributors over the public-health crisis caused by painkillers, writes Riley Griffin for The Philadelphia Inquirer.

Endo said earlier this week that it will pay $10 million of the settlement. It will also donate $1 million worth of diabetes and allergy drugs to resolve claims by two municipalities in Ohio that claim Endo played a role in fueling the nation’s opioid epidemic by illegally marketing its Opana painkiller.

This settlement resolves only two cases against Endo set for trial in October. Lawsuits against the company filed by more than 2,000 local governments remain intact.

The October trial against other drug manufacturers will also still proceed.

Endo officials said the settlement with Ohio municipalities does not reflect what it expects to pay to resolve the remaining opioid suits.

“The cash portion of the settlement approximates the estimated cost to Endo of proceeding through trial,” said Matthew Maletta, Endo’s executive vice president and chief legal officer.
