West Chester Resident Wins Snow-Shoveling Case, Helps Others Do the Same

West Chester resident Jenny Steinen, a sixth-grade teacher and former lawyer, has successfully challenged a snow-shoveling ticket she received nearly six months ago, writes Michaelle Bond for the Philadelphia Inquirer.

Steinen was told that she had violated the Snow and Ice Removal law, which requires that all snow be removed within 24 hours. According to a code enforcement officer, she left a dusting of snow on her sidewalk 25 hours after a storm on Dec. 9 and 10 and was fined $25.

Knowing she had shoveled her sidewalk, she took her case to District Court and was found guilty of violating the ordinance. But she appealed to the Chester County Court and won last month.

However, while she did not have to pay the fine or $89.71 in court costs, she did not receive a refund on the $50 fee for the appeal hearing. But even so, she believes it was worth the fight.

“I’m afraid people pay the ticket even if they shovel,” she said. “They feel it’s hopeless to try to fight for what is right.”

She also encouraged a neighbor to appeal, which he did and ended up winning, causing officials to re-examine the ordinance.
