Toll Brothers Appeals Denial of Development on ‘Crown Jewel’ of Westtown

On Monday at the Chester County Justice Center, Toll Brothers presented its appeal of the denial to construct a housing development at the Crebilly Farm site, writes Michael Rellahan for the Daily Local News.

The developer is asking Common Pleas Court Judge Mark Tunnell to overturn a decision made last year by the three-member Westtown Board of Supervisors. The board denied Toll’s conditional use application to construct a 319-unit subdivision on the property along Route 926 and South New Street.

The developer’s plan is opposed by residents who claim the property is the “crown jewel” of Westtown and should be mostly left untouched.

Toll Brothers maintains that the decision was contrary to law and an abuse of discretion. The developer claims the denial was not supported by evidence presented at public hearings over the last two years.
