West Chester-Based Radiate Athletics Held in Contempt of Court

By

West Chester-based Radiate Athletics has been held in contempt of court over its athletic t-shirts that change color in response to body temperature, writes Fran Maye for Daily Local News.

The company’s owner, Kenneth E. Crockett Jr., reached a settlement with the Office of Attorney General last year in April, but failed to comply with the terms.

Radiate raised $579,000 in an online crowdfunding campaign but failed to deliver the shirts to many consumers. And some of the delivered shirts were defective. The initial goal of the Kickstarter campaign was to raise $30,000 to finance production. However, Crockett kept the campaign going until it had nearly 20 times the initial ask.

Now, the owner and the company are facing penalties and the restitution of $262,606.24. Also, in addition to forfeiting the right to do business in Pennsylvania, the defendants were ordered to make the payment by April 12.
