Judge Won’t Turn Freedom Medical Lawsuit Into Class Action

Despite exemplifying a widespread insurance industry problem, Exton-based medical equipment provider Freedom Medical’s struggles to get a particular insurance company to pay interest on its late reimbursements have been denied a second time from escalation to a class action lawsuit.

“Although the Superior Court’s opinion is unpublished and generally nonprecedential, it has certainly cast a pall over the remaining medical provider class actions pending before this court, particularly the present one,” Philadelphia Court of Common Pleas Judge Gary S. Glazer was quoted as writing in coverage by The Legal Intelligencer.

The judge decided that the many factors that affect each overdue payment case — including causation of a medical issue, insurance coverage and the medical necessity of equipment — can’t just be lumped together in a single class action case.
